Since the fact that the woman was drunk is the entire plank on which her case is based, how can you say you agree with vortex's point?

As long as we metaphorically shrug our shoulders as though we are saying 'Boys will be boys ...' then you are right, nothing will change.
I just happen to believe that we owe it to the women in our society, and to ourselves as men in a civilised society, to make it clear by education and appropriate punishment, that this sort of behaviour is simply not going to be tolerated - and certainly not on the basis that it has been up to now.
Society changes itself - if it has the will. We don't put children up chimneys or down mines, so why should we accept the rape of intoxicated women as a calculated risk they take in order to go out and consume alcohol.
