I own an empty property jointly with my brother. He is refusing to either rent or sell it. I have heard that it's possible to "force a sale" but I'm not sure if this only applies to creditors?
if you are joint owners then effectively you can sell it, if the other trustee refuses he can apply to court to stop the sale but needs to have a reason not to sell
Yes, you can raise an action for division and sale in the court. Unless there are exceptional circumstances as to why the property should not be sold, the court will order the sale of the property and the division of the proceeds.
