My mother bought a pedigree dog from a breeder, they sold her because they felt she was ugly and not show material and was no good for breeding as she was having a phantom pregnancy (although i felt they ripped my mum off) a week after my mum brought her home she had a baby and my mum was scared they would take the dogs off of her. my mum has spent alot of money on these dogs as she was having problems with labour, needed jabs and stuff. now the breeder has found out that she has had the puppy (now about 3 months old) and has gone to my mums house and told her if she doesnt allow her to breed from the puppy she will take the puppy from her.


i was wondering if anyone knows the legalities of this or can direct me to where i can find out.

If you have told us all the story and in the UK and as I understand it, unless your mum signed any agreement that the breeder could have any puppy back or allow any puppy or the dog to be bred from, then the breeder hasn't a leg to stand on. She can tell the breeder any more nonsense and she will go to the police. She might also like to get a fixed fee interview with a local solicitor for more detailed advice.

thank you very much, mum spoke to her vet this morning and the vets are very good, they said that they will talk to thier solicitors about it and that they are 98% sure the breeder cant do a thing, but will check with their solictors, and also if the breeder does try to do anything the vet will back mum up all the way.
I would get the pup spayed that way she won't be able to have any pups and the breeder won't be interested. She doesn't sound like she has the dogs welfare at heart.

Even if the dog is registered with the Kennel Club and your mum hasn't transferrred the registration to her name it still legally belongs to your mum (registration is NOT proof of ownership).


Did you mum have a receipt for what she paid? If so, this is proof of ownership and unless the breeder has a signed contract by your mum agreeing to 'breeding terms' then the breeder has got no authority to demand any money or the puppy back.


As you say, she cannot be a very responsible breeder and I would tell her you will report her to the Kennel Club under Rule A42.


It might be a good idea to get them both spayed, then there is no question of either of them being bred from, particularly as the mother had a difficult time.

sorry for the delay i have been away over christmas, she didnt get a receipt (which i lectured her on) but i was told to phone the kennel club and they said the breeder has no entitlement what so ever. i have told my mum if they do harrass her then do get them done (im a huge fan of getting animals neutered as it can cause lots of nasty health problems if they are not breeding)
