i work for a scottish based company and travel in a company van not all smokers in the van. is it legal to light up once at the english border or not because it is a scottish company van and place of work?

No, you can't smoke in the van with other passengers- it's still a work place. I'm not sure about the border thing, but it wouldn't be very nice for the others. x

As yet the anti-smoking law has not been enacted in England, therefore it is not an offense south of the border.


whiskeysheri is right - you can't light up in the car, even if it's your own car, when you are on work business. It still applies even if you are the only person in the car!


Not sure about once you cross the border into England. If you're driving from England to Scotland, however, the ban applies as soon as you're over the border, even if in a car/van on your own on work business.

oh good question! my boyfriend is furious that he cant smoke in his work van, even though he is the only one EVER in it. It's ridiculous
If its a company van, and the company is Scottish, I imagine the policy is that you are not able to smoke in it - reglardless of where you are driving. It depends if your workplace has a Smoke Free Policy - and being Scottish, I imagine it does. Has your company offered you any support eg.access to a Stop Smoking Service/Nicotine Replacement Therapy?
