istcredit debt collection agency

I have been hounded relentlessly by 1st credit debt collection agency whos only approach to a debt is pay up or court action or bankrupcy will be issued they have not taken into account basic living expenses of me and my dependant child when demanading a repayment plan be put in place, circumstance of the debt arise from divorce in which i am awaiting financial sttlement which they have evidence of can they get away with this ?

I think CAB help anyone. The debt company would have to take you to court if they wanted to send baliffs round or issue bankruptcy. I'm not sure, but I think the court send you out papers to complete showing your income and outgoings and they decide how much you should pay from that (don't take my word for it though!).
You need to agree a repayment plan with them, you can't just hope that they will go away because they won't.
Send them details of your income and expenditure and offer them an amount that you can afford to pay each month. Then if they do take you to court, the judge is less likely to make you banckrupt as he will be able to see that you have been making attempts to pay.
Don't ignore them and do nothing, you could end up with a CCJ against your name or at the worst, they could petition to make you bankrupt (you don't say how much the debt is).
CAB can help anyone, it doesn't matter that you own a house and have a job.
