I sold one of my skirts on ebay to a lady for £5. I am a size 12-14 and the skirt fitted me perfect as it had a complete stretch waistband. The skirt didnt have any labels in as i cut them out from irritating my leg. Anyway, the woman has had the skirt and claims is a size 8!!! Ive tried to message her saying its not because i was my skirt and i am a size 14. Shes having none of it! Shes sent me message after message saying shes going to shop me into ebay for all to see what a liar i am and that shes chucked the skirt in the bin and doesnt want a refund, she just wants my reply to her negative feedback removing! Ive told her i will not remove the feedback reply (in which i put BEWARE abusive member!) unless she removes the feedback she gave me. Shes said she wont do this. She has now set up a claim on Ebay (not paypal) under item not described. Shes even put in the claims notes that she does not want a refund as she has thrown the skirt away BUT wants me exposed for the liar that i am? What do i do? I havent sent her any abusive messages i just put "i am a size 12-14 and skirt fits me fine, its not a size 8, it has a complete stretch waistband. I am sorry but this is the chance you take on ebay, if something doesnt fit properly then it isnt my fault as i have been completely honest about the size"
Ebay said shes not harrasing me until she starts swearing (even though these messages are threatening and in an abusive tone!)
Can she stil claim a refund if she has freely admitted to me and ebay on the claims form to throwing the skirt away and saying she doesnt want a refund?

I can't be of any help but just wanted to say I gave up with ebay a long time ago. I resented having to use paypal as I had heard of some dodgy practices by them and that people were getting unfounded refunds by them just because they could 'work the system'

You have done all you can. You offered a refund and she has refused. She sounds like a chancer to me. I would call Ebay and detail everything that has happened. Do you still have the messages she sent you? If so they can access the messages with your permission and that will prove her abusive attitude toward you. I have had to deal with this before and Ebay have always been very amiable.

Have you opened a dispute on eBay with this, or has she done this already? In this process you both get the chance to have your say, and eBay will make the decision. I must admit that if I don't agree with someone complaining that "item is not as described" I will always offer a refund but only once the buyer has returned the item in the condition I mailed it to them. She can't return the item so she can't have a refund - she has bought it then disposed of it. I just have a feeling sometimes when people make an unreasonable fuss like this, that she is wearing the skirt but just wants it for nothing. Have you checked her history on eBay (by clicking on her feedback record)? This might not be the first time. The key thing here is to respond to the dispute, if you don't then eBay have to make a decision in so many days - and say that you would have been quite willing to refund on receipt of the returned item. eBay are reasonable, I have had no problem with them when disputes have been raised but your buyer sounds like a stinker, and trying it on.
BTW cassa, I have had no problems with PayPal, unless a dispute is found against you by eBay then the only person who can initiate a refund from your PayPal account is you.

Just wanted to update you. She has 778 positive feedbacks BUT they are all from buying and sellers as you know CANT leave negative feedback so if she has scammed no one can put about it on the feedback of hers! Anyways, ebay have removed her negative feedback now off my profile as they deemed it abusive and a breach of their rules for feedback so thats good BUT the case is still open now for another 7 days so i shall have to wait and see what happens :(
I rang ebay to ask them about this claim and they said i have to sit out the 10 day wait on it and see what the decision is!!!

Yes, i agree on paypal. I have only ever won 1 battle on there and that was because the buyer didnt reply to the email on time that paypal sent out! The rest of the time the money has been taken off me and rewarded to the other side! I say "the rest of the time" its been about 4 times in the space of 4 years...still, she tried to convince me on the phone that they are NOT bias! phffhh!
she is probably hoping that for such a small amount you will just beg her to accept a refund to save your feedback... and all this hoohah is just to be more convincing
just because she wants the item for free...she probably buys lots of low price items and i imagine a lot of sellers will not want the hassle for a few quid...

did she claim INR or SNAD?
If the latter then usually PP will ask the buyer to return the item and enter their proof of posting (buyers are not required to prove delivery) into the dispute for their refund to be actioned so logically she should not get her refund
However, it has been known for PP to refund a buyer without them having to return anything
Good luck - unfortunately this type of buyer is becoming common and sadly the neg she gave you will still go against yr total FB score even though it's been removed
