And, just to understand completely, the bank have offered you this 10k before or after your payout?
Your question doesn't really make a lot of sense because although the banks are giving back individuals £1,000's in some cases, why would they offer you an extra £10k?

Hi ojread2- I don't think this £10000 will be in addition to a refund. I think the bank will be saying that they don't necessarily accept liability but will offer £10000 instead.
I would expect them to be able to withdraw the offer before payment if there had been a genuine error but once they've paid it I think it's unlikeley that they'd change their mind and seek to recover it- unless they felt that the claim was fraudulent in some way.
Is the £10K a good offer? How much were you claiming?

Hi
Thanks for your replies- was expecting about 3k and they offered £13197.05
I phoned the Ombudsman who said it was a FIRST!!! have no idea why they would offer more- have tried 4 times to get hold of them and they keep saying the case oficer works nights and the system is down!!
What I really wanted to know is can they claim it back from me once paid? as it is a goodwill gesture???

It's still not clear to me whether the bank has actually used the term 'goodwill gesture' and , if they have, whether it relates to all of the payment or is in addition to the payment.
Or are just assuming that because you expected around £3000 and got £13000 then the difference must be a goodwill payment.
Have they given an explanation of how the £13197 figure was calculated- is there a breakdown?

Hi- they have made a" goodwill offer", in one sentence, and then the next is "goodwill gesture" anyway, have spent the entire morning trying to speak to someone and "the system is down" and there are no "case officers" so have signed the offer and sent it off- so we will see what happens!
But am still unsure if they can retract the offer? can they claim it back after a few years if they have made a mistake? Hope someone can answer that.

OK. So the whole £13K offer is a "goodwill" one. I suggest what that means is that they are doing it without formally admitting any liability. I don't think it means they are deliberately offering you more than you are entitled to.
Are you sure the total amount you paid for PPI was about £3K? Don't forget that you were almost certainly charged interest on the PPI instalments & the interest would have been front end loaded - i.e. shown as a part of the total loan amount on the Consumer Credit Act agreement at the outset so each of your monthly instalments would have included some interest on the PPI as well as the interest on the loan. However, interest should not have added £10K to a PPI charge of £3K!
