My Mate Lent Me Some Money About 6 Months Ago She Told Me It Was A Gift Now She Has Told Me To Pay It Back Or She Will Inform The Police Can She Do This?

She can prove the money went from her account to yours.

She could start proceedings in the Small Claims Court - it would cost very little.

If she can convince the court it was a loan she will win and you will have a County Court Judgment against you.

Can she afford to give �1000? That could be her argument - that it was never a gift because she needs the money herself.

You will have to convince the court it was a gift. Was this typical of the gifts exchanged between you?

The best thing would be to get this girl out of your hair for good and pay her back. Why should you want to be obliged to her in any way? Get some self pride and pay it.

ethel- why should i pay her back it was a gift she wants the full amount and there is no way i can afford the full amount she wont take it in intallments i have tried on several occasions so what do i do now ??? and self pride does not come into it
delooze..you stated that 'you transferred the money from her account to yours.' Does this mean you used her passwords to access an online internet account, or did you complete this transaction at the bank? It's important to say slearly which you did as the repsonse could be quite different.

i did this via online banking
all sounds very foolish, she shouldn;t have trusted you as a friend should she, now she has to pay for it, I would try to make some effort to pay her back, she could blacken your name all over town over this
if youve tried to pay her in installments then let it go to caourt, thecourt will probably allow it to be paid like that.

Why would you offer to pay it back if youre sure it was a gift, and why keep referring to it as a loan?

Im surprised she hasnt reported it as theft if you took it from her account she can just state that you had access but not permission to take it.
Similar thing happened with my friend, we lived together I covered the bills and rent she was supposed to pay me back and then all of a sudden she owes me near on a grand. I asked her for it she never gave it to me, we fell out for a bit and got over it.

Sounds like you could get into trouble for obtaining cash by deception. If she takes you to court and its easy to fill out the forms for small claims, so its not like it will cost her a solicitor. The way you got the money doesnt sound right...... she can claim you got it fraudulently I suppose.


Ethel, Jay Vesuvio is no longer gracing the site. I went back to laugh at the man thong and it had disappeared!
My husband is a builder and we own a small firm, he did an extension for a couple who held back the final payment of �3000 saying they had ran out of money !! having took people to Small Claims court in the past, winning but them not showing up etc etc i knew it was a complete waste of time and energy. We gave the said couple months and months then on a final visit the cheeky ******* were having a conservatory put up !!!!! I sent the boys round to remove �3000 worth of brickwork first giving them seven days notice in writting ! The said couple attempted to get us done for " criminal damage " unsuccessfully because i could prove they did not own the bricks id removed i did, they than took us to small claims court ...Of course we did not bother to show up knowing the system from personal experiance, they won in our abscence but the small claims court have no way of enforceing there judgement so whats the point ! been 4 years since that horrible insident and nothing has ever happened, and i certainly dont have a CCJ cos iv seen my credit report.... Sod her, she has no proof and if she takes you to small claims court, dont go !!!

Gummybear - of course small claims judgements can be enforced - by bailiffs, charging orders, attachment of earinings orders, or garnishees.

None of them are guaranteed - but more fool you for not enforcing any judgements if they have been of sufficient value:

You can even force a bankruptcy on a debtor.
When you use capital letters it feels like you're shouting at us! And it makes it more difficult to read.
I don't like the sound of this at all. If someone used online transactions to take money from my account, I'd notify the bank and call the police, but on the other hand, your friend's details should've remained private, for her and her alone to use. Sounds as though one of you is being deceitful. Either your friend gave you some money but she's now trying to claim it back by making out it was a loan - or you've taken more money than was agreed - and it WAS a loan. If you were genuinely given this money as a gift (and not just because you'd helped her in the past and thought it was your right to have something back) - let it go to court or wherever. It'd be best to try & talk things over first.
If you have tried to pay it back via installments, aren't you admitting it WAS a loan?

You may well have shot yourself in the foot.
