Bankruptcy
3 Answers
I hope someone might be able to help me on here. A few years ago my sister ran up some debts on various store cards and a contract phone. Two of the companies took out a ccj against her and she applied to the court for a administration order. She included all of her debts in this order and she was paying them 5.00 a month. A few weeks ago she had a letter from the court stating that the administration order was paid. After this she tried to upgrade her current account but was told that she couldn't as she had been declared bankrupt. But she has not. She told the bank that she had a administration order and the ccjs but they said that bankruptcy was showing on his records. So she obtained her credit report from Experian but it doesn't mention the bankruptcy on there either. So my question is why is it showing on her banks records but not on her credit report.

There are 3 credit ref. agencies so it could be worthwhile getting her records from Equifax & Call Credit. If they are the same as the Experian one she needs to go back to the bank with the evidence (including the papers about the Admin Order) and ask them to check again.
If they have referred to some internal bank record then that seems to be faulty & needs to be put right. She could ask them to check the Insolvency Service bankruptcy record (on their website) which should show she is not bankrupt. If she cannot get anywhere with them, she should put in a Data Protection Act request to get full details from the bank of all records they hold about her.
