is it illegal for employers to withold overtime wages that they forgot

Probably haven't done it through the payroll though hopkirk. It's too much hassle 'rolling back' to correct a mistake. The company I worked for, depending on the amount, would either wait for next pay day or give them a payment as a loan...

yes ummmm and h.r dept and they have admitted they are at fault

Have they explained why they can't pay him till November? If they have admitted fault then I presume the money will be paid.It might be a good idea to go back to payroll a week before he's due to be paid.

If you bank account is running into overdraft because of this problem, write formally to them, giving them the details and ask that you be paid now the money due to you out of petty cash if they can't do another specific payroll run just to rectify one person's error.
