the mechine seemed to not be taking my card at the store and the cashier told me to swipe it again and now i find out it did work and i was charged 3 times and the mercahant refused me a refund

Tell the merchant that you are going to report it to the police as fraud.

That is theft. The vendor must reimburse you. Ask them one more time to refund your money, if they still refuse go to the police, the fraud team will help you.

there's no problem - just go to your bank where the card is affiliated to - they will refund you with no problem - you might a wait a little but you should get it all back - don't waste any more time with the vendor or police at this point

This happened to me last year. (Well I was charged twice for something as they said first had failed.) I simply reported it to my card company; they sent me a form to fill in and reimbursed me, saying they would let me know if the retailer disputed the refund. I got the money back and heard nothing more.

Has the merchant given a reason why they won't refund you? It seems odd given that they can see from your statement and their records that there were 3 identical transactions

They could claim/believe that you bought three items, and separated the payments. Time between each would imply that wasn't so though.
