Remortgage and stamp duty
4 Answers
My husband and I are about to remortgage our house. He has a single mortgage on it and his name is on the deeds. We are hoping to arrange a joint mortgage with the deeds in both our names. The lender's solicitor has mentioned that we may need to pay stamp duty. Is this likely to be the case?

Just to make sure you know that you are then liable for the debt also, whereas now it is in your husband's sole name. If anything were to go wrong with the marriage, and of course hopefully it would not, but you only have to look on this site to see how it happens, then obviously you have then remortgaged the house and also become jointly liable. I know you might feel that you are not on the deeds, but as his wife you would still be entitled to have an interest in the property.
