Seperated from Ex and he owes me money

My partner (now ex) and I moved out of our homes and into a flat which we rented 50/50 and my sister rented out the spare room. When furnishing the flat I bought everything apart from the fridge, this includes all the bedroom furniture, sofa, dining room table and chairs, etc.. I bought the majority on credit and have the receipts as proof. We split up recently and me and my sister decided to move out as he had no where else to go, with him agreeing to give me money each week towards the furniture. 2 months on we have just found out he has his new girlfriend now living in the flat and still I have had no money towards the furniture that I am still paying for and they are using to live. My sister still also has a few items that he has said he would give back but hasn't. How can I go about getting money from him to pay for the furniture they are both now using? I have tried to be reasonble but now he won't answer his calls or the door when we went round to talk to him. I also still have a key to the flat and he has rung the police saying that we have been in their taking things which we haven't. Please help as this is seriuosly getting out of hand, I am not the jealous ex making problems for them, I left him and just want back what is mine!

You can either go round when he is out and take all the furnuture. Obviously, you won't always know when he or his girlfriend are going to be there unless you watch them. If not you are going to have to go to the small claims court and ask for your furniture back and try and get them off him that way. The small claims court is not always great when they are dealing with this situation because if he doesn't go to court or he is not in when the bailiffs come round you have to pay more money to send them round again. I found they were a waste of time in my case when I tried to use them. My first answer is better and for the same price of hiring a van and getting some mates to help out is cheaper than the court fees.

Thank you, I was thinking of doing that but seeing as I don't live there any more will that not be breaking in and could he not report it to the police?

You say you rented the flat 50:50. Does that mean the tenancy agreement was in both your names? If so, has the agreement been cancelled? If it has not, you are still a tenant as well as your ex and I think you have every right to go into the property - you could even go back and live there if you wanted. But you should also be aware that, if the tenancy is still in both your names the landlord could pursue you for the whole of the rent if your ex fails to pay it because the liability is "joint and several".


If the tenancy was always in your ex's sole name, or if there is now a new tenancy in his sole name, you probably do not have a legal right to go into the property. It might be an idea to go to a local CAB or Law Centre to get advice on this, particularly as your ex has already involved the police (albeit making unfounded allegations against you).

The lease was in my name I am not sure whether or not he has changed it since I moved out, but I stopped paying rent in November. He has now sent me a text warning me to stay away or a will be sorry, this could be used as evidence against him with the police right?

I bet the lease is still in your name. Men are too lazy to deal with that sort of thing. Go in and get your furniture. Keep the text warning on your phone in case he gets violent later. Have some back up of some guys in case. He cannot do anything, it is your property and you are claiming it back.
