a friend of mine... has a big problem her mother signed a joint agreement with her brother to get a loan but didnt get any of the money which she knew what would happen


her mum has now moved & her brother is saying he will not pay & gave her new address to company



she is staying with friends


what i am asking does my friends mum have to pay if her brother doesnt she doesnt want to break up family or should she say as her sister in law suffers bad from deression & susidle


i dont know how to help as not my problem any helpful advice please

Yes she has to pay if the brother doesn't. The loan comany can pursue each of the joint borrowers for the full amount of the loan.


Don't understand what you are trying to say about the sister in law. It will mean nothing to the loan company.


To be honest it looks as though she walked in to this with her eyes wide open, as I suspect did the brother.

Yes - the lender can chase either of the borrowers for the full amount. If your mother cannot afford the payments she should get advice - from a CAB, or maybe Payplan or CCCS. If your brother could afford the payments but is just refusing to pay the lender should be told this - they could take Court action, but would probably do so against your mother as well.
