Step brother owes money - how to get it back??

Hi,

My step brother recently borrowed �1,100 from me, he promised to pay it back to me on the 21st March but when i called him he stated that it would be saturday at the latest (25th). The money has never arrived and when i try to call him his phone is switched off. When i went to visit my dad (he lives there) they said that he was at his girlfriends, however they did not know were she lives. How can i get the money back (without resorting to violence) can i take him to court or sue him? What are the steps i should take, and what does the law say about this? any help would be great, thanks.

Before you take any court acion, you have to give hime notice in writing - pointing out the two failed deadlines for repayment, but insisting that it is repaid in full within a week from the date of the letter.

If this fails then you can make a county court claim quite easily at a cost of about �60 (which you cann ask for at the hearing). Youn can either get the forms from your local CC or go to www.moneyclaimonline.com - they issue papers within a 48 hour period. If he fails to lodge a defence within a thirty day period, then you can make an application to the court for a judgement by default.

Thanks for the reply. I will make a start on the letter right away. Can the cost of taking him to court be claimed back?
