i want to sue the army

i was injured 10 yrs ago whilst serving in the army and have tried to sue them twice since leaving without sucess as my medical records go missing. my truck turned over dislocating my knee. secondly i was sent to bosnia and i have been on the sick with combat stress syndrome for years now. is it possible to sue the army after this lenth of time?

if you have unsuccessfully sued them twice, wouldn't that give you a hint? the army are a big organisation, and i dont think it is coincidence that your medical records have gone "missing"
Also i wonder why you would want to sue them? Surely those things are just the risks you take when you go into a job where you might be in a war situation? How was it their fault your truck turned over? How is it their fault that you got combat stress syndrome (i dont know w hat that is, so im willing to have my mind changed on how that was your employers fault)
If those things were due to negligence on your employers part i could understand ... although, again if you sign up for the army, you sign up for all that it entails, not just the travel and pay and good stuff, but also the fact you might be called upon to go to war

not quite sure if you are being sarcastic there or not. I'm not saying that it definately isn't negligence on the army's part, but i just hate this "compensation culture" that seems to have grown up in this country (uk) Stuff happens, and sometimes it's nobodys fault, but people feel they should be finacially compensated for it . I am immensley grateful that we have the army to defend us, but i wouldn't say soldiers would be entitled to anything other than what anyone else would be entitled to should they not be able to work because of stress. Anybody who gets stressed throught hteir job would be entitled to say that the job caused it, but i doubt they would be able to sue their employers unless they had been negligent. I would imagine that people in the army know that they are going to be subjected to more stress than the average person would encounter in their lifetime, and therefore take it into consideration before joining up.
Josas, i clearly dont know the details of your incidents, but after 10 years, it might be just best to accept it and move on as it were, as bitterness and anger only hurts you, not the person it's directed towards

I served in: northern Ireland, 1st Gulf war (infantry) Bosnia, kosovo, afghanistan (RAMC) so I've seen more action in the NAAFI than you have in your carreer and im not sueing. I despise people like you. You are a disgrace. Your medical records have gone missing have they? absolute RUBBISH!!!! they cannot go missing, they follow you around with the rest of your service documents, ask your medical centre for your FMED's and your Admin Office for your P File.

i can not belive the answer that have been given. what a load of anally retarded none empathic paople you are. yes while agree that joining any of the forces comes with it hazards combat stress is serious and can affect a person on different levels. i asked a question not here i am come and insult me and my intelligence, my truck was turned over due to neglience of an officer. in bosnia i was taken captive as a woman you can imagine what that would entail. i had to dig up bodies of young children and babies and have seen other sites that even have my doctors crying, so please dont give me bull shit.

i joined to escape my family. i very much loved the army and had done tours before bosnia, but it was over there that changed my whole out look on the army and afterwards i decided to leave.

if it was a persons fault that the truck you were in turned over then wouldn'y you be better suing that person? It's not like the army were negligent. Imagine how you would feel if you were driving and the same thing happened and they tried to sue you.. I'm sorry if you dont like my answers, but that's life and im sorry if you think i'm anally retarded(???).

What did you think you would be doing when you joined the army?
You mention that you are "on the sick" so i imagine that either the army are contributing to that, or you mean standard sickness benefits, which is all anyone could expect if stress forced them to leave their job. At the end of the day, how will money make you feel better about having to dig up the bodies of babies?
and i don't mean to belittle your experience, but where would we be if every nurse who had to leave through stress sued the nhs? Or every soldier injured sued the army? In answer to your original question, i would imagine your solicitor would be able to tell you if 10 years is too long
josas your not big enough to knock me on my a**e, trust me mate, bigger MEN than you have tried and failed, grow up and stop crying you whinging baby. I was at Sanski Most when the massacres were being carried out, and buried mothers with babies in their arms, it's not nice to see but you need to get over it and get on with your life. it happened, dont sue, thats for the Yanks.

So you think you're the only person to have wittnessed terrible things whilst carrying out your job? A job which you chose to do and by the sound of it you did whilst whinging constantly about how hard done by you were!

The fact that you've had two claims turned down already must tell you something. Do yourself a favour and forget about the past and stop trying to blame someone else for your own inadaquacies!
By the way, if you're "on the sick" how do you intend to pay any legal fees incurred by a third claim?..I wonder.

I am sorry you feel your life has disintegrated since you left the army but in war and battle situations as happened in Bosnia things go wrong all the time. Accidents happen, as they do in civilian life and looking for somebody to blame will not change the situation. If every military officer, firefighter, policeman, doctor and nurse tried to sue for stress as a result of the everyday situations they have to deal with, the country would be bankrupt.
You freely admit you joined the army to escape your family rather than wanting to serve your country or accept the challenges that life in military service would inevitably bring. Do you think you perhaps have an unsuitable personality for accepting responsibility for your own life? If you haven't already had counselling, perhaps this would help you to move forward. If you don't want to spend the rest of your life living on benefits, please try to put the past behind you and take some positive action to enjoy what life you have left. You are privileged not to be one of the poor individuals rotting in a mass grave. Resolve to be grateful for that and try to move on. None of us can change the past in our lives. All of us have the power to influence how the future turns out.
