my partner is selling his property, it is in his name only and he has had it for 12yrs. His estranged wife left two years ago. As she lived theire for 3 yrs my partner thinks she is entitled to 50% of the property for thethree years she was there. Is this right?

She would certainly have a claim and could also prevent him from selling it by registering an interest. He needs to negotiate with her.

Hi thanks for your quick reply, she has put a restrictio on the property but has agreed to lift it once she receives her payment for the 50%, but she wont agree at this stage to a full and final settlement, so my partner was worried that if she took this money she could come bck later and ask for more from the profits, altho she is getting more than 50% worth of the three years she was there.
Well wouldn't it be better to get a divorce and have it all finalised so there are no comebacks later. It might cost a bit more now but better than having a ticking timebomb.
