I have a joint mortgage with my ex partner who moved out due to the relationship break up. we have a daughter together. He was paying �90 weekly towards the mortgage and has now decided not to pay anything. Is he under obligation to pay towards the mortgage? He has asked me to remove his name from the mortgage, of which i cannot do until my new partners flat has gone through with sale. My ex does not believe that i am dealing with taking his name off the mortgage but cannot do so yet as i cannot be solely on the mortgage & need my new partners flat sold so he can be joint with me. My new partner hasnt lived with me for 6 months yet which i believe is the amount of time by which my ex can legally refuse payment. My ex wants his name removed asap and does not want payment from the property & instead i will be putting the share in a declaration for my daughter. He says "he's giving me the house, so he doesnt have to pay anything".

Can my ex refuse to pay me towards the mortgage or does he have to pay until his name is removed from the deeds?

He should pay really but I don't see how you can make him.

I can sort of see why he won't pay, if he doesn't live there then why should he, but if the mortgage is still in joint names then he should.
he could demand that you sell it. Ok he has 1/2 obligation to house your daughter, but no obligation to house you. Imagine if the tables were turned, and he had custody of your daughter, and a new partner who she might look on as a substitute and you had t pay for that
Think your self lucky that he let you have the house.I battled for my house for nearly two years with my ex!
