can you get your husbands name off your house mortgage with out refinanceing. if he agrees

I once bought out my ex-partner - I did not have to remortgage the house, I just gave him some money representing his interest in the house, and with the building society's permission his name was taken off the mortgage (and off the Land Registry entry obviously).
The answer is yes, provided that the lender agrees. The lender will need to be satisfied that you can service (maintain the payments on) the loan. Otherwise you may need a 'guarantor' - a person of good creditworthiness who will guarantee to maintain payments if you fail to.
