Does anyone know if I can use the voluntary termination clause on an HP agreement if I am the executor to the person named on the agreement?

HP is with Santander and they have confirmed that the loan qualifies but I just wondered whether they will allow me to walk away (car valued at �2k yet �6700 owing on agreement).

Also does the fact that the car has covered 1000,000 miles in three years mean I will be liable for any shortfall?

An Executor can exercise any rights or options that would have been exercisable by the deceased party to the Agreement.

WHether or not there will be any shortfall liability will depend on whether the mileage was limited in the contract.
You personally will not be liable for any shortfall - the estate of the deceased is
