returning something that doesnt fit

I asked this in Dee Sa's thread and got nowhere. As shops aren't obliged to refund you, do they not have to give you your money back if you were given clothes for christmas that don't fit you.

No...it's not their fault. Some will and some won't.

No they don't have to but most do out of good will.

Mind you having said that if the shop does not have changing facilities then there could be room for negotiation perhaps. I don't particuly like trying things on in shops and always ask if I can bring it back if it doesn't fit.

However you could ask for a credit note or exchange it for something that does fit. As with anything though you should make sure it is in a saleable condition with the tags still on.

(Sat 10:27 02/Jan/10) Report ThisI am always very pleasant and just say " this was a present from my dozey dad and it doesn't fit" then wait while you count slowly to 10. Most times they will fill gap in conversation by saying " we only give credit notes " or " "would you like to have a refund?" If they offer to exchange it smile again and say that it doesn't suit you at all and wait again. but remember they don't have to offer you anything as the contract ( legally speaking ) is with the purchaser not the giftee. Retailers are under no obligation to refund or even exchange goods which are "unsuitable" for any reason.

If you can get hold of the receipt this would certainly help but most shops only change up to 2 weeks after Christmas, good luck.
