ask the council where you are on the list (they can send you your positions based on area's you have chosen) failing that add more area's that you would be prepared to live in

You won't be able to rely on having two children of opposite sex - this is not considered overcrowding at any age. It is classed as 'natural growth'.

You can't force the council to move you, sadly. Keep a record of your neighbour's behaviour and keep the council informed. Hopefully the council will take action against the bad neighbour.

If you went homeless than you probably already have a secure tenancy, if that is the case then you can put up for an exchange. if you are willing to exchange with housing association you will have more luck as the rent is more expensive. If not when your eldest is 5 you will be eligible for for transfer. Get yourself on the transfer list now and by the time that comes along you will have points for waiting. You can also get 30 points for jsut keeping your house in good condition.
Do you call the housing department every day saying what your neighbours do etc., you need to keep on at them.
Even say its making you ill and maybe even frightened to go out!!! not sure if this is the case,
Im sorry to say i had similar situation 4 years ago.
I lives in 2 bedroom flat with 3 children and i kept on at the housing department every day, i was 11 floors up and was cramped, in my case both me and my partner worked, and not until i finally managed to buy a house and about a week before i moved out, did the council offer me a 3 bedroom house, well you can imagine what i told them !!
st1ck it!!!! it annoys me and im not prejudice but people come in the country and get housed straight away yet there are people like yourselves who are desperate to be moved and can't mainly cos these people take all the homes that become availiable.

I know this gets me angry too, there building a new estate in our area and all HOUSES and are giving them too immigrants, ive lived here all my life and get stuck in a flat!! Systems all wrong, council dont seem to care, ive complained bout the noise many times but to no avail. What keeps me going is that there are people in worse positions than me and some who havent even got a home. I'll probably be here for another 15 years unless i get a turn of good luck for a change,or i win the lottery which is highly unlikely or an exchange but no-one is gonna want to live here!!! aaaghhh.
I know how you feel honestly i do, i used to even go around and look for empty council homes and ring the council up about them but it didnt matter cos i was 319th on the list of something! and i woudl hardly go up the list you know why, cos more and more people were getting put in front of me those who know how to work the system!!! makes me sick.
I used to live in Caterham Surrey with my Mum and children after my relationship broke down. It's a lovely area and there were simply no council houses as all of them had been purchased under the right to buy. It was seriously over crowded at my Mums but all they could offer me was a half way house many miles away from my friends and family and it still would of meant all of us living in one room. When i asked how long i would be there it turned out one woman and her kids had been there 6 years!
Just by luck one day i got chatting to a woman who asked why i didn't rent a property and get the social to pay housing benefit? I had never been told this was an option but sure enough after a visit to the benefits agency i found i could to do this and rented a property for me and my children. My experience of the benefits system is that they will never tell you what you can claim, there are agencies out there that specialise in telling people exactly what they are entitled to i would suggest a visit to them as even if the council do rehouse you, you will have no guarantees that it will be a better area.

The only thing with renting from a private Landlord the council will only pay around 90% of the rent. You will have to pay the Landlord yourself.
Also if any repairs need to be done i.e. new bathroom after a few years, you will have to talk to the landlord not the council so it will be a harder process.
As for the complaints of housing being offered to immigrants first, you all will have to make a brave stand publically as wispering will not get you heard.

I understand it must be difficult living next to a neighbour like that and i think you need to keep writing letters about this to the council. If its really bad you need to get letters from your health visitor/doctor saying its affecting you and your kids health. Write a letter to council every week saying you need a transfer because of this neighbour. Do you have close family/friends in another area? You can say you need to be near them for support etc.
I dont think they would class a 3yr old and baby in one room as overcrowding. I think the oldest has to be at least 5yrs. Even then it is not a legal requirement. I know someone who has a 13yr old girl and a 1yr old boy in a two bed and they wont be moved soon! I also know someone who had 5 kids in a 2 bed for ages, they then got moved but only to a 3 bed.
I'm not sure about the council just giving Immigrants all the houses, if they need a council house they have to go on the waiting list the same as everyone else.
Probably most of the Immigrants you see have bought the council houses they are in. On my estate their are loads of immigrants along with others who have bought the council houses. The problem is not them but the fact that people can buy the houses at all. Also that not enough new ones are built i suppose.
Mutal exchange is another way but i doubt anyone would want to move into your place if the nieghbour is that bad. if you lie to them about that, is it really fair.
