husband buying me out
5 Answers
My husband & I separated 2 & half years ago. We put the house on the market for 350,000 over a year ago but it hasn't sold. Our mortgagage is only 50,000 so have a lot of equity. So, if we got 350k my half of the equity would be 150k He has now decided he would like to buy me out so his girlfriend can move in. However he's only offering me 125k as the market is so bad but my point is there's no advantage for me to sell at the bottom of the market and I'm not in any hurry, it just suits him at the moment. I have paid half of the mortgage for 2 & a half years without living there so feel I've been very fair to him. I'm not going to stick out for 150k but something a bit closer than 125k! What do other abers think?

How much mortgage payments are you making? say it takes the market 3-5 years to recover - would you have paid the extra 25k in mortgage payments by then? Do you really want to be hanging onto this link with him? You already split 2.5 years ago - what if you are tied to him for another 3-5 years???!
You'll probably have to get the house revalued and go from there.
Whatever you do - go through a solicitor. A male friend of mine recently went through something simlar. He agreed on a lower figure for his wife to buy him out, and he agreed this without a solicitor in the interest of goodwill. She now has the house in her name and he's only had half the money!
