i want to move to australia where i have citizinship and so has my son who is aged 9. Where do i stand legally with taking my son out the country away from his dad? i know his dad will protest, but he wouldnt have any money to go down legal route. If i told the dad what i was doing he prob would get some kind of legal document stopping me taking his son out the country or something...anyone know the score on this?

I wanted to move away with my son and new husband a few years ago and was told by my solicitor that I couldnt even move to Scotland without the permission of my son's dad. Scotland is classed as abroad! So I guess you will need to get his dad's permission or go through the courts. Go see a solicitor they usually give the first half hour advice for free
