I am the grandmother
I have a 7 year old grandson that lives in an abusive home with his father, My daughter is the mother and everytime she goes for custody the father thretens to kill her, what right do i have so i may get gardianship?

I went to talk to the lady at CPS and she told the father what I had done. When my daughter went to get her son the father had told CPS that she was on drugs. She went and had a hair folicul test that proved she was not on drugs, but the father seems to be able to get around all the legal stuff and still have his son. I then went above the workers head and tried to file for gardianship and the woman from CPS told the father and I was told I couldn't see my grandson anymore. I nee to Know how to get around all this and get my grandson to his mother. Please if anyone knows how PLEASE help me. And thank you so very much for your answer to me. My daughter is scared that if see doesn't do as the father tells her to he will hide their son and she won't get to see him at all. So I am trying to step in and help her all I can.
I don't know anything about USA legislation regarding family law, I only have experience with it here in the UK, however, I would say though that you need to continue to report or at least record every single episode of abuse to the child that you hear of, dates, times and what happened etc and you absolutely have to get yourself a good solicitor.
If you or your daughter (frankly, it would be better if it were your daughter, at least that's how things work here) were to be awarded custody, you might also file for an injunction. Try to help your daughter be brave, if she goes for custody and he starts getting agro, she must call the police or report the threats every time and thus build up a portfolio of offences with which you can use as evidence.
The first thing to do is find yourself a solicitor (lawyer) who can fight on your behalf. Please do fight for your grandson, he sounds like he is in a terrible situation and he is helpless. Maybe you could encourage him to talk to a teacher at school who also might be able to file a report to the social services about the abuse he is privy to or receives.

I'm so sorry , like mimi I have no knowledge of US law, but she seems to have offered excellent advice. Have you maybe tried this question on a US forum as this one, good as it is, is mostly answered by those in the UK and we really won't have much of a clue as to the intricaies of your laws. Good luck though and I hope all works out well for you.
