My mortgages flat is let out. But how would I stand if I asked a solicitor? I am trying to save costs to see a solicitor had thought about CAB but spoke some time ago and bit vague and referred me to family law solicitor. I have read I could be given permission to live in his house until girls were adult but somewhere read permission for just 6 Mths. I am very worried about break up for children let alone any arguments about this. I just want to know where I stand. My flat is one bedroom small with lounge kitchen and not big enough for us to life in. Also if he did move out how can I affor council tax and bills how to people manage. Thank you
You stand out in the street homeless.
If you are not married you are just a person who shares a house with someone else.
The house and estate will go to his children who can then do what they want with it. There is little chance for you.
I am not sure what you mean here by ''I have a mortgages flat'' do you mean you have another home? if so even less chance of getting anything if your partner dies.
The only way you may get anything is if your partner has made a will benefiting you over his children but even that is likely to be contested particularly if you have your own flat somewhere.

I think - if I understand sewme correctly - that she is thinking of leaving. She won't get anything if it's his house and her name's not mentioned, and she doesn't pay any bills. He does have an obligation to keep a roof over his children, if she takes them with her - but that's child maintenance, not a case of her getting a share of his house.
As you have now confirmed you have your own flat which is let out, you have both a home and income, so you will get absolutely nothing if your partner dies.
You will have to end the tenancy of the people living in your flat and move in your self.
By the way, I hope you took out a' buy to let' mortgage or you may have the flat repossessed as well if the mortgage company find out.
