My gran sadly passed away in Feb 07. I KNOW she made a will as she told me, but my uncle sorted it all out when she died and he has not mentioned the will once. He is her next of kin (as my mum died quite a few years ago) and then it would be me and my brother (we are her grandchildren). He said he closed her bank account down (he has her death certificate)and put the money in his off shore account. How can I prove she made a will? Or cant I?

For more on marking an answer as the "Best Answer", please visit our FAQ.it looks like your uncle is being rather devious here samfm if i were you id tell him you KNOW your nan made a will and it ought to be read as that would be her wish.he may turn round and say that she made him executor of the will in that case he should make provisions for the will to be read by the family solicitor.id press him on this issue if i were you as something doesnt seem quite right as he has put the money in an off shore account id be asking him why he has done this.another thing you could do is if your nan had a solicitor id be asking them if your nan made a copy of her will and left it with them she may have done.good luck.
You need professional advice from a solicitor, if your Gran had a solicitor who is not the same one your Uncle uses ask to see someone. Ask them if they ever had a copy of her will, your Uncle may already have acquired this if he knew about it.
Like Stokeace says your Uncle sounds to be devious, this is why you must see a Solicitor your Uncle does not use.
I may be wrong, so ask your Solicitor how the money should have been shared if there is no will, as I believe that the money should have been divided between your Grans children, not just the surviving children, and you and your brother should have received your late mothers share.
To start with only ask for advice from your Solicitor , if he starts requesting wills or writing to your Uncle it will cost you a lot of money.
When know what should have happened you can contact your Uncle yourself, your Uncle may back down when he realizes you know what you are talking about, if he still refuses then ask for a Solicitors letter to be sent.
If you find that there was a will which has been through probate you can obtain a copy from the Probate office in your area at a cost of about �10.
Don't forget to ask for interest on any money you find you are entitled to, there are times when you are not entitled but it is worth a try Good Luck
