Getting child maintenance from my ex wife

Hi all, hope someone can help with this one. I am a seperated father living in Spain with my daughter. My wife left us both 7 months ago and has returned to England after having an affair. She has refused to pay me any child maintenance saying that because I live in Spain, she doesn�t have to...nice! I have no address in the UK and have cut all ties there...Any ideas would be very welcome.

If you have no idea where she is in the UK then I wouldn't think you had got a hope in hell of getting maintenance from her.

People who livein the same country as their exes have anough problems getting them to pay maintenance, never mind if you are living in a different country.

why not try going through her family? perhaps her mum and dad will make her pay up?

Thanks Guys, Yeh I know where she is...she's back at her mothers. Her mum is not happy with her but puts a roof over head and although supportive of me and my daughter she wont get too involved

To right she should not get involved, she should remain impartial for her grandchild's sake. no matter how bad her daughter has behaved
you are in the european union remember, of course you can make her pay, well at least a court order to pay will happen wether or not she will pay is a different matter, and you will have to keep going back to court till you get a court order to take direct from her wages.
But do you really want your daughter to see her father stressed out pursuing her mum through the courts for a few quid. and as you are living in spain it will cost you a fortune, as the hearing will be held in the country of your residence. no free lawyers in spain.

You'll have to chase it up using a lawyer. Do you work for a company over there? If so, are you a member of the Trade Union as they should be able to help you with legal matters, both in Spain and abroad (i.e. the UK)?

best answer of the lot mate...made me chocked to be honest. Thanks a lot pal...whoever you are. Decided to knock the maintenance on the head and just carry on struggling...its not worth the hassle..thanks to you all.

Don't carry on struggling! Why should you? She has just as much responsibility as you. If this was a bloke we would all be up in arms about him paying so why shouldn't she?

CSA have no rights when the parents live in different countries but you can apply through the courts.

It's a two way street when you have children and yes I do respect you for bringing up your child alone but only as much as I do any single parent regardless of gender.

All absent parents should pay for their childs upbringing so bring her to book!!

Don't let her get away with it. If the shoe was on the other foot she'd chase you to hell and back to get her money, and rightly so. Stick it out - the money's for your child, not you - don't give up, that's my advice for what it's worth. Good on you.
