Getting child maintenance from my ex wife
11 Answers
Hi all, hope someone can help with this one. I am a seperated father living in Spain with my daughter. My wife left us both 7 months ago and has returned to England after having an affair. She has refused to pay me any child maintenance saying that because I live in Spain, she doesnt have to...nice! I have no address in the UK and have cut all ties there...Any ideas would be very welcome.

you are in the european union remember, of course you can make her pay, well at least a court order to pay will happen wether or not she will pay is a different matter, and you will have to keep going back to court till you get a court order to take direct from her wages.
But do you really want your daughter to see her father stressed out pursuing her mum through the courts for a few quid. and as you are living in spain it will cost you a fortune, as the hearing will be held in the country of your residence. no free lawyers in spain.

Don't carry on struggling! Why should you? She has just as much responsibility as you. If this was a bloke we would all be up in arms about him paying so why shouldn't she?
CSA have no rights when the parents live in different countries but you can apply through the courts.
It's a two way street when you have children and yes I do respect you for bringing up your child alone but only as much as I do any single parent regardless of gender.
All absent parents should pay for their childs upbringing so bring her to book!!
