can the father stop me adopting my civil-partners son

my civil-partner gave me PR, her child was born in 1999 and she never married the farther, but he's on the birth certificate, do i have to adopt him?

the child doesnt want to see the father, not that we've stopped can he stop me from adopting him?

You need his permission to adopt. That means trying to track him down. Shouldn't be a prob if he never met the child.

you cant just give a child a new parent, even if the dad has never seen her, he is still the dad. To adopt you must get the dads permission. Of course if you track him down to ask him it might mean he wants to strat having contact

have been thru this with my ex, my new partner adopted my girls, ex never saw them, we enrolled a solicitor and we went to court for them to decide as he hadnt seen them for 5 yrs or contributed to there upbringing, a court officer spoke to my daughters to see what they wanted, my new husband was granted consent to adopt my ex didnt attend court to plead his case and was served papers via a court officer letting him know we was taking him to court.

where ever possible, I think the child should be encouraged to see their father if there is no risk involved.

The boy will be given a new registration for the adoption which will tie into his original birth registration, he will be able to decide when he is older which name he uses, the one on his original birth certificate or his adoptive name. The father i he knew you intended to do this and he also was close to the child would probably object and block the idea, through the courts if he felt strongly enough, but that is the scenario of a caring and devoted parent, someone you don't describe in this childs father, so get the legal advice in a free 15 mins appointment and take it.

unless the law has changed no you don't need his permission to adopt but in the 2 cases ive seen this happening they have told the fathers of the plans ,this was 16 years ago though and not being disrespectful ,the women had got married ,so i don't know the law on civil marriages and if they hold the same grounds

If louise was never married to the father, wouldn't the child probably have her name anyway, meaning it wouldn't change?
