Out of Date Drinks

I recently bought a bottle of diet coke from a local takeaway, the bottle was a coke a cola brand but it was a Spanish bottle. The coke was flat and when I looked for the sell by date I found a date of 05/2008. On returning to the takeaway to complain I was told that this date was the 'from date' and had nothing to do with the use by date - is this correct and can a takeaway sell a foreign bottle

He is correct,it is in fact probably the bottling date.
Yes,anyone can sell drinks/food etc from foreign companies.
If you read the small print on bottles/cans/packets,you might be quite amazed where it is from.
Technically speaking it's not even a "foreign" bottle,it was produced in the EU which for these purposes counts as one economic area.

Although some brands are international. in each country the company is, to some extent, independant. It's perfectly legal for a cash and carry (which is where your shop probably gets his supples) to buy goods in other EU countries, import them and sell them here.

At the cash and carry, one brand of cola sells for around �11 per case (plus VAT) when sourced from the GB company, but could be a couple of quid per case cheaper when sourced from another EU country. Would you care to guess which one a small shopkeeper is more likely to buy ?

And no, I'm not a small shopkeeper, but I do occasionally get to find out the cash and carry prices for a few things.
