breville fryer

i have been given a breville fryer as a gift, can anyone tell me if the basket should sit on the element, it don't look right to me, and although the booklet says it is possible to cook without the basket, how on earth can i cook a piece of fresh fish dipped in batter, surely the batter will stick to the element, as you can guess this is the first time i have had this sort of fryer, i don't like the idea of having the element in the oil, any advise will be useful.
