Yes and yes. There have been a few publicised court cases where drink driving offences were thrown out as the police neglected to determine whether the offender had recently used mouthwash prior to being nicked. Nowadays they make you sit for a minimum of 30 minutes following alcohol intake, and question you on your oral activities, prior to the breath test. (I was routinely checked, and passed, before you all think i'm a drink driver). Bear in mind that you don't actually (well you're not supposed to) ingest the mouthwash so your chances of being nicked are very slim (depending on your blood-alcohol level)
Mouthwash also contains a lot of flouride which helps your teath, but ingested will cause a lot of damage. Don't even think about drinking it.
I used to work as a store detective and i once saw some old alcoholic vagrant type pick up a bottle of lysterene mouthwash and down it before he got to the door i was so shocked and impressed not to mention how much i felt sorry for him to get like that that i didnt arrest him.
