Boots of Springheel Jak

I'm having problems completing this Thieves guild mission. I went to a beggar in the Imperial City who gave me the location of Jakben, Earl of Imbel. I went to the house, talked to his servant (or whatever he is) who said that Jak isn't in. However, I went to his study area and I indeed found Jak - he gave me the key but I whacked him with my blade (as well as casting a destruction spell), he then disappeared (Doubt he died), I went back down from the study area trying to find Jak: could't find him. I proceeded into the Catacombs, fighting off a few vampires, I went to Jak's coffin, looted it, read the diary yet jak didn't appear behind me to attack - I can't find him! What's worse is that I can't simply load back as my last load is miles back (Yes, I should save more often i know!) HELP
