Pedestrian Access on our land?
1 Answers
We are deciding weather to proceed with a purchase on a house problem is that its become apparant that there is a right of access which is on foot only for teh neighbouring property. Basically the house we have is detached with a garage one side, with a gate next to it, and gate the other side of the house. The garage side gate and path leads to the garden and half way down the path there is a garden gate into next door. This is described on the deeds as a 'right of way on foot only' for the neighbouring property (believe technically an easement?). The neighbouring property is a semi, garage on the side which provides access straight to their garden so this path is hardly a neccesity. Problem obviously is we dont like the idea of people walking through our property as nice the neighbours may be also sell on issues. Can this type of covenent be removed ie can we buy this off the neighbours? I understand sometimes deeds cant be changed even if both parties want them to? Does any one have any advice in these issues ?
