Terminating a tenancy with no agreement

Myself and a friend have been tenants privately renting a flat managed by a Lettings agency for the past 3 years - we are now 3 months from the end of supposed current agreement. I say supposed because we have just realised the last tenancy agreement we signed concluded in June of 2006. The agency offered us another 12 months tenancy - but never sent us the new agreement.

We now wish to move to another property and being three months from the end of this "supposed" tenancy are not sure how to proceed about giving notice etc? Do we need to give notice? How should we do this? We have paid rent and are up to date with all obligations for the whole of the time we have stayed here.

have u asked the agency? how much deposit have u all payed? if u have no agreement, then tell the landlord that your agent is crap! and ask to leave. Check with your potential new agent as they will be more inclined to help you
