Hi there people, here is a legal question. I want to replace the fence at the back of my garden but it's a fence that is dividing a house whose house is at the backof my garden, and we both share the same fence. Do I need permission toremove the fence and put up a better concrete structured one up?

Why don't you go round and ask them if they would mind. If the fence is tatty and you are not asking them to fork out any money. I can't see you would have a problem.

You need to check your deeds with your BS to see if you are responsible or they are or it is joint, if it is joint u do need to ask them, as they may want the fence to be in keeping with other borders etc.  It would be better to ask now and get it right than end up with/as a neighbour from Hell!
