i found i tiny black snake with an orange band around its neck any one have any idea what type of snake it was and wherre or not i should leave it in my garden?

I would agree it sounds like a grass snake, although i would have described the orange band as more of yellow colour.

Please put it back where you found it, its harmless and may still be hibernating. Just cover it to protect it from the elements. thanks Good Luck..
