Tree roots blocking drain. Owner refusing responsibilty.

Hi,

I live a close with two drains. Everytime it rains heavily the road gets flooded. We have had it inspected and have been told it is due to the roots and leaves of a tree that is owned by someone in the joining road. The owner denies the tree is his as it is outside his hedge. Our close is full of old people who can remember the tress being planted by the former owner years ago. How can we prove the tree is his responsibility?

Contact a solicitor who can trace registered owner of offending property (or, if it's unregistered, may be able to filet out info from your own pre-registration deeds) and then send polite but stern letter warning what will happen if owner fails to comply with maintenance covenant benefitting your property).

Contact your local council to see if they own the tree, as you have been told it is on their land, let them do the legwork to see if your neighbor owns it instead of you paying for a solicitor.
