who is responsible for trees planted in housing authorty garden that have grown to tall,but were not planted by the present tenant. who is liable if they are blown down.
If they were there when the current tenant moved in, then it would be the responsibility of the owner of the land unless it states in the contract to the contrary and it may well do that.
If it is a large tree then it could have a preservation order on it, in which case you will need to speak to the council if there are concerns about it blowing down.
If they are blown down, nobody is responsible - it's an act of god.
The owner would only be responsible if they were negligent which basically means either cutting off branches to make it lopsided or cutting through roots to make it less stable.
