Can my X throw me out, despite me paying everything?

Me and my boyfriend, bought a house, because in past yrs i had some debts(that are now cleared) we were unable to have the property in joint names, only his. a few weeks after moving into the property, he left, saying if i wanted to keep the house, then all i had to do was pay the mortgage and i have been doing this for 3 yrs, and of course all the bills..Now i am wondering, what if he comes back, do i have any claim to the house at all, i have done many repairs, and the house has gone up around 80,000

However, from what you say you have a valid claim for an equitable share of the proceeds and you must formalise your claim and make it known by registering a Caution at the Land Registry. This blocks your ex from completing a sale until your claim is settled - very important for you. You could do it yourself only if you understand legals because sometimes complicated questions are raised by the LR. You will be safer doing it through a solicitor - cost to enter the Caution �100-�150 - and should your ex try to sell the solicitor will be the best person to fight your corner. Should you wish to move out your claim can be quantified and the Caution is still effective so that you must be paid when the house is sold. Often the entering of a Caution starts people talking sensibly again and a way is often found where one is paid off leaving the whole property with the other.

I did not have my diary with me when I answered you last night. The Caution is entered by way of a Unilateral Notice and the Land Registry fee is �40. If you fancy doing it yourself go to www.landreg.gov.uk click forms/publications click forms and print off Form UN 1. It is straightforward to fill in.
you need to get your mortgage changed asap into your name ... ask your boyfriend to do this but legally you may need a solicitor. also there are many mortgage companys now that will give you a mortgage this happened to my partner but both names were on the mortgage but the x just signed it over ...lucky!, legally you may be seen as just paying his mortgage for him (letting the property)so keep all documentation and go and see him nicely and get your mortgage in place before. he may want some fee for doing this and don't go to a mainstream mortgage company every time you get turned down for credit it effects your credit rating even when asked to complete those questionnaires in the street for catalogues.goodluck
