we have recently cut down a sumat tree but it still keeps coming through and its where we intend to put a patio

sumachs are little devils for suckering. If you can wait a while and treat every sucker with brushwood killer then see if any more emerge, you might solve it. Other options are to grind out the stump with a stump grinder and then dig over and remove ALL of the suckering shoots...or sell the house and move !!!
