Returning an item to an Amazon seller

I bought an item through an Amazon seller that was not up to the description and is pretty useless. It's not faulty though. I've contacted them through Amazon with a complaint and they have agreed to refund me if "The item must be returned in its original condition, with packaging intact / like new and include all accessories"
My problem is I've had it 2 weeks and the packaging went out with the recycling. Can they refuse me a refund because I don't have the original box?

If they agreed to a refund on that condition, then yes, they can refuse you. Pity you did not realise straight away that it was not as described. You can tell them and see what they say, but to be honest if someone had something off me and after having it for that long rejected it and did not have the packaging I would not be happy to take it back.

Really? Big boxes (TVs) etc I might keep but this is small, the size of a paperback book.

Surely under the Sale of Goods Act you are entitled to a refund if it is not "fit for purpose".

what is it? if its something that works but perhaps just isnt as fast or powerful as you had hoped then they can refuse you on that, so i imagine if you have thrown the box away they can refuse

i dont think they mean the amazon cardboard box, they probably mean the item box
