Who would you be suing?
A claim against who? It is your garden.

on tv it advertises a personal injury
If it happened in your garden, then you would be claiming against yourself.
There is no-one to blame other than yourself?
///on tv it advertises a personal injury///

Ok, so now you need someone to sue for your compo, the owner of the garden you tripped in would be the one in my opinion, I mean they should have third party cover on their household insurance, but, hold on a minute, that's you isn't it, see the problem?
I think you've got the wrong end of the stick.
If you have insurance I'm sure you could make a claim.
You'd be wanting to sue yourself for having a dodgy foot causing you to trip in your own garden?

There may be troubles ahead.........

"Where there's blame there's a claim"

Even if this happened in somebody else's garden or in a council park you'd have difficulty successfully suing the land owner.

You would have to show the landowner was negligent in some way that caused you trip, for example an obscured fixing of some sort in the ground.

You would also have to show that you wasn't negligent - you were watching where you were going and taking extra care because of your numb foot.

As this happened in your own garden you cannot sue yourself. Your only chance would be if you tripped over something left behind by a builder you had contracted, in which case you'd sue the builder or other obstacle put their by a third party without your knowledge.
dylan - on tv it asks: 'Have you had a personal injury which was not your fault?'
I'd sue you. how very careless.
Thanks for making me smile, dylan
You appear to be the "occupier" within the meaning of the Occupiers Liability Act, since you describe the garden as your own. So you are not a visitor. You owe a duty of care to your visitors. The law does not provide for you to have a duty of care to yourself. Therefore you have no claim.
..... and this is one of the reasons why this country is so screwed.
It seems we've become a nation of suing everyone at every opportunity.
Anyway, you've certainly me me giggle ...... you trip in your own garden, partly due to a dodgy foot, and you're considering suing someone ????
you do not get free cash whenever you make a mistake!

YOU tripped up - no-one pushed you or tripped you or made you fall ... no-one except YOURSELF!

the ads state that you can claim IF the accident is caused by someone else's negligence - not just for any and every accident!
^^ As gizmonster. This is so ridiculous, it is funny.
Don't rush into this Dylan. I've got a feeling the other side are quite litigious & will probably counter-sue you.
You're not a serving Police Officer by any chance are you?
