Wasps Nest

I use a public footpath occasionally which is very narrow and fenced in - just inside a private property and adjacent to the footpath is an old tree stump with a wasps nest in it at head height and about two feet away from anyone using the footpath. Just out of interest is there any precedent should someone get stung? Are the owners of the property in any way responsible or do we just take pot luck.
I hasten to add I have no problem with it whatsover, I'm just really interested to know the legality of the position. Thank you

They only have to keep the path passable....wasp nests don't come into it.
