If I was on a driving lesson with a qualified driving instructor and I broke the speed limit, who would recieve the penalty fine and points on their license? Myself or the instructor ( who is technically in charge of my driving and has a brake pedal in a dual control car, and could therefore slow me down!) Just wondering :)

You would be liable as you were driving!!!!!!!!!!!!! Youy also have access to the break pedal (that's the middle one)

sep41999 - I thought as much, I wasn't talking about burning around at 100mph, rather going a few miles over the limit which is easliy done when you're a learner and trying to concentrate on what seems like a million things at once! PS. My car doesn't have a 'break' pedal ( in the middle or anywhere else ) It has a brake pedal :P
I was wondering this the other day. In reply to above, on most learner cars (the ones that are fitted with the signs and stuff) the instructor has a clutch and a brake pedal too.. what's the law on that and you're speeding?
That answer is wrong. The driving instructor is responsible, as he is resposible for the car - you have no insurance of your own and whats the point in putting penalty points on a provisional licence? You may never get a full one so the points will mean nothing. Similarly if the instructor is drunk while you are driving he can be done for drink driving, even though he is not driving. He is always responsible for the car.

You would both be done judging by the way our laws work and incidentally points can be and often are placed on provisional licences and are only removed three years after the licence has been made to a full licence.
