Car a total loss but no log book

My car has been declared a total loss (gutted). The only problems is that i have not received my log book from the dvla. And they can't find the application.
Where does this leave me with reguard to my claim? Will they pay out seeing as there is no V5 and the car looks like its not in my name??

Speak to your insurers, but I believe that you will have to ensure that the seller of the vehicle informed the DVLA of your purchase using their portion of the V5C, which should give you the opportunity to follow this up with the DVLA to try to confirm your original application and to request an original, or duplicate V5C.

It is up to the previous owner to send the portion of the V5 off to get you the new V5 , have you contacted them to ask if they have done it? You have to get them to write to the DVLA and confirm the date they sold the car to you.

You should have been given the small tear off portion of the V5 by the previous owner when he/she sent the rest of the V5 away. This is what counts as your proof of ownership until the new V5 arrives .

Is it a category C or above? If so complete a v62 form available from any taxing post office or from www.direct.gov.uk/motoring and send to V.C.S., DVLA, Swansea, SA991BA with a signed letter advising the date you aquired the vehicle, and the date it was declared a total loss. You will be added to the record but as the vehicle would require a VIC check before any docs can be issued you will be sent a letter explaining along with a microfilm copy of the necessary information(takes 2-4 weeks) required for an insurance claim which you can then pass on. If it's a cat D then you still complete the v62 but send it to the address on the form(by the signature box at the bottom)enclosing either the green new keeper supplement(v5c/2 as mentioned above) or £25 fee as a cheque or postal order made payable to DVLA Swansea and you'll recieve a v5c within 4-6 weeks.
