Could you please tell me if I am entitled to make a claim for a Whiplash injury, when I was a passenger in my farthers car when he crashed?
Im not sure if it matters, but I am also insured 3rd party on his car insurance. But obviously I was not driving at the time of the accident.
Many Thx.
As a passenger you are insured whatever cover your father has. It is immaterial that you are insured as a driver 3rd party. You will be entitled to claim under your father's insurance which will cover for accident injuries whilst you were a passenger. All insurance has to cover for injuries to passengers.
So you will have to claim against your father and he will pass it on to his insurer. Contact a claims company/solicitor and they will send a threatening letter to him, or send him a letter yourself.
You may want to notify the police and ask for him to be prosecuted.
Did he damage any property when he crashed
Your dad should expect to receive a bill for the damage to the barrier, although he should pas it on to his insurer.
By the way, the answers assume your dad was properly insured
If someone has a genuine injury that may cause that person to be off work and possibly lose out financially in addition to what can be long term damage then the insurance is there to make any necessary claims. It isn't to be taken personally, this is what insurance is for and why we all pay premiums.
I wish you a speedy recovery.
I know from experience (both sides) that whiplash claims are surprisingly easy even if the collision was minor, although it can take 12-18 months before the cheque arrives
I dont understand why people would find this shocking. I thought that was what insurance was for? I got injured and will be off work with a genuine injury that my doctor has consulted me for. It isnt an attack on my father, he suggested it i get compensation for his insurer. I that so wrong?
