It is the sellers responcibility to make sure the goods arrive in good condition. The seller has make good any damage and refund you if nessesary. It is 100% down to the seller to compensate you and then for them to try to reclaim their costs from the courier.
You the buyer DO NOT have to try to get the cost from the courier , that is down to the seller. All this is explained in eBays terms and conditions.
MyHermes do not cover damage to fragile items unless extra insurance is taken out, but that is not your concern it is down to the seller.
To answer your question , Yes it is right and it is the sellers problem not yours. The seller HAS to refund you and then try to reclaim the costs.
