Did anyone ever here of someone getting personal compensation for arthritis in the uk?
I fell over on my knee 4years ago,i tore ligaments and a chip came of my knee-cap.I di not know the extent of the damage until 5months later,even then,nothing more was done,only pyhsio and that did,nt help.I have constant pain in it every day and iam unable to kneel down and play sports.I have o take a lower paid part-time job now.
I seen a solicitor after it happened,the other side(insurance company) are dragging ther heels.My solicitor had to get a court order to get an engineer out to the premises were i slipped.
My knee is getting worse and my GP said iam getting arthritis in my knee.
If i win the case will i receive money fo future pain and suffering and future loss of earnings?
Would i receive money for arthritis?
Its the council i have the case against.
Would they let acase like this go to court?thanks for your help and comments.uk

If you win on liability the amount of damages awarded will take account of the injuries to the knee if they can be shown to be a consequence of the accident and future loss of earnings too if i can be shown that this is a direct effect of the accident..

I have just tried to claim compo for tripping in a supermarket, and thought I had it all in my favour - witnesses accident book, two months off work and to cap that an MRI scan that confirmed I had suffered a serious knoock to the knee.
Unfortunately, there are too many get out clauses for the other party, and the same would apply to a council (ie, did you trip in a road? - they can claim it was checked within a certain time period and get out of it that way) but getting back to the 3 years, I was trying a no win no fee job, and he said he couldn't touch it but if I wanted to pay and proceed, make sure I did it within 3 years of the accident.

If the arthritis is proved on the balance of probabilities that it was caused as a direct result of your injury, then you should get compensation for it. Loss of earnings as a result should also be calculated. The insurance Company should have you medically examined and if you are not satisfied with their report, then your solicitor should arrange for a medical report. These reports should give a prognosis. It is best not to settle claims too soon because of any long term effects.
