Hi all,

to cut a long story short my company is currently in the process of making people redundant. at the end of it all there will be one clerical job left. I have six and half years service and a good attendance record and the other girl is nine weeks pregnant and has only been here since sept 07 and has a really bad sick record. my question is would she be priorty over me to get the last clerical job with her been pregant?? does lenght of service not come in to it at all??

Strictly speaking, it is the JOB that becomes redundant, not the person, so it on that basis that decisions are made.

So even tho she is pregnant it does not mean she will get the job over me just because of this??

So,you got a fellow worker pregnanat,and you wonder why they are making you redundant?

If the position that remains after the redundancies have taken place is the one you currently hold then strictly speaking it should be you who gets it. Similarly if it is her position now it should be hers afterwards. It is more likely that the position is not exactly the same as either of the jobs the two of you currently hold and so the company can choose which one to keep. They may use 'Last In - First Out' in which case you are more likely to stay or they may use any other reasonable method to choose between you. This can include qualifications - job knowledge - timekeeping - sick record. They must not use her pregnancy to either give her the job or refuse her the job.

The way I understand it is that someone who is pregnant cannot be dismissed simply for being pregnant and no other reason. I understand that it is still possible to dismiss them for other reasons as long as it is fair and provable i.e in the case of theft by the pregnant employee. I also believe that they are not protected any more than any other employee, in the case of genuine redundancies. I presume that there is more than one person doing the same type of job that is to be made redundant? If so, I believe you are all entitled to the same considerations regardless of if your colleague is pregnant or not.
As I said this is my understanding and not necessarily 100% correct, it is best to get proper legal advice. Cheers Sue
